ACCEPTANCE OF TERMS RestoEquip.com provides through its website at http://www.RestoEquip.com (the “Website”) a collection of classifieds resources, including classified ads, forums, and various email services, (referred to hereafter as "the Service") subject to the following Terms of Use ("TOU"). By using the Service or Website in any way, you are agreeing to comply with the TOU. In addition, when using particular RestoEquip.com services, you agree to abide by any applicable posted guidelines for such RestoEquip.com services. We reserve the right, at our sole discretion, to change, modify or otherwise alter the Services or any other good or service made available through the Website. Should you object to any term or condition of the TOU, any guidelines available on the Website, or any subsequent modifications thereto or become dissatisfied with the Website in any way, your only recourse is to immediately discontinue use of the Website. RestoEquip.com will not refund any remaining balance in your account. RestoEquip.com has the right, but is not obligated, to strictly enforce the TOU through any means deemed appropriate. 2. MODIFICATIONS TO THIS AGREEMENT We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. You must review the TOU on a regular basis to keep yourself apprised of any changes. CONTENT You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the Website or made using the Service, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item ("Item") of Content that you post, email or otherwise make available via the Website or through the Service. You understand that RestoEquip.com does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the RestoEquip.com site and Content available through the Service may contain links to other websites, which are completely independent of RestoEquip.com. RestoEquip.com makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. You acknowledge that RestoEquip.com does not pre-screen or approve Content, but that RestoEquip.com shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Service, for violating the letter or spirit of the TOU or for any other reason. 4. CLASSIFIED ADS & SUBSCRIPTIONS You understand that certain postings comprising Content advertising goods or services for sale are considered as classified ads (“Classified Ads”). You understand that Classified Ads posted through our Service are paid ads. The fee for Classified Ads are access fees permitting Content to be posted in a designated area. Each party posting Content by Classified Ads to the Website is responsible for said Content and compliance with the TOU. All fees paid will be non-refundable in the event that Content is removed from the Service for violating the TOU. You understand that purchasing a Subscription Plan entitles you to post a specific number of Classified Ads on RestoEquip.com. You understand that each Classified Ad posted will decrease your remaining Classified Ads, the total of which is indicated at the time of purchase of the subscription plan. You understand that purchasing any Subscription Plan comes with a specific period within which you must post all Classified Ads, or forfeit unused Classified Ads at the end of the subscription period, without any refund or recourse against RestoEquip.com. The posting time period to use all Classified Ads is effective from the date of purchase of the subscription plan. You understand that your subscription start and end dates can be viewed from the ‘My Account’ option of RestoEquip.com. You understand that subscription plans are non-refundable. You understand that from time to time, RestoEquip.com offers discounts for promotional purposes, using discount codes. You understand that these discount offers can only be used one at a time, and that discount codes cannot be merged in any way, under any condition. You understand that each Classified Ad posted shall inherit the Classified Ad properties of your Subscription Plan, unless additional ad features are specifically added to a given Classified Ad by you. You understand that downgrading options for Classified Ads (for plans that include extra options) are not offered by the Service. You understand that following the posting of a Classified Ad, your Classified Ad shall remain visible in your posting category for a period of 30 days. Following this duration, your Classified Ad will become inactive and shall not be visible unless re-posted. Re-posting a Classified Ad carries the same cost as placing a new Classified Ad. You understand that a regular Classified Ad is meant to be an ad posted without any additional Classified Ad visibility options enabled for said Classified Ad (such as the priority option, highlighted option and featured option). You understand that a Classified Ad purchased with a priority option shall mean that this Classified Ad will appear over regular Classified Ads (outlined above) within a given category, but that no specific order is assigned for ads purchased with the same priority option. You understand that a Classified Ad purchased with a highlighted option shall mean that this Classified Ad shall be highlighted within a given listing category, but that no specific order is assigned for ads purchased with a highlighted option. You understand that a Classified Ad purchased with a featured option (“Featured Ads”) shall mean that this Classified Ad shall be placed in a rotation to appear on the RestoEquip.com homepage under ‘the Featured Ads’ section, but that no specific order is assigned for Classified Ads purchased with a featured option. Due to volume of Featured Ads, RestoEquip.com rotates these Featured Ads for each site visit by both unique and non-unique visitors. You understand that each Classified Ad can only be edited one time after the complete initial Classified Ad submission. For further changes or corrections, you must contact the site administrator with specific correction instructions. If changes and corrections are deemed reasonable by RestoEquip.com, they shall be applied within a period of 72 hours following email confirmation by RestoEquip.com to you. You also understand that RestoEquip.com will not make any changes or corrections that change the Item that was originally offered, or the overall spirit of the original Classified Ad. To this extent, RestoEquip.com is not obligated, under any circumstance to reply or notify you of change, correction and / or replacement decisions. You understand that a given Classified Ad is comprised of one Item for sale. Each item shall be accurately described in the Classified Ad Content title, description and its associated pictures. It is strictly forbidden to: - Post multiple Items under one Classified Ad - Group multiple items for sale under one Classified Ad - Misrepresent the quality and / or price of the item The above posting restrictions do not apply for items that are typically sold grouped on the open market. Any intentional mis-categorization for the purpose of grouping items shall be deemed a violation of the TOU. RestoEquip.com, at its sole discretion, reserves the right to suspend or terminate any Classified Ad posted, without any additional liability or refund. 5. USER INFORMATION & INFORMATION PRIVACY RestoEquip.com collects information as part of the registration process, billing process and Classified Ad Listing process. - We collect your email address, for purposes such as sending self-publishing and confirmation emails, authenticating user accounts, providing subscription email services, registering for forums, etc. - For Classified Ads, we collect contact information, such as name(s), phone number(s), and address for billing purposes. - RestoEquip.com does not store credit card information. Credit card transactions are transmitted to a financial gateway (PayPal), and we endeavor to protect the security of your payment information during transmission by using Secure Sockets Layer (SSL) technology. - We collect personal information if you provide it in feedback or comments, post it in a Classified Ad or interactive forums, or if you contact us directly. Please do not post any personal information on RestoEquip.com forums or classifieds that you expect to keep private. - Our web logs collect standard web log entries for each page served, including your IP address, page URL, and timestamp. Web logs help us to diagnose problems with our server, to administer the RestoEquip.com site, and to otherwise provide our service to you. You understand that information that is deleted may be stored on other RestoEquip.com servers for archiving and historical purposes. RestoEquip.com takes privacy seriously. At no time shall we ever re-sell or share your private information with any other party. Your contact information is displayed when posting a Classified Ad. The information displayed in such a case is: - Your First Name - Your Last Name - Your Telephone Number - Your Ad Province - Your Ad City - Your Ad Postal Code RestoEquip.com may disclose information about its users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. RestoEquip.com may also disclose information about its users to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to claims that any posting or other content violates the rights of third-parties; or protect the rights, property, or personal safety of RestoEquip.com, its users or the general public. Your use of the RestoEquip.com website or the Service signifies acknowledgement of, and agreement to our Privacy Policy. 6. THIRD PARTY CONTENT, SITES, AND SERVICES The Website and Content available through the Service may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of RestoEquip.com. CONDUCT You agree not to post, email, or otherwise make available through the Website or Service any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, is harmful to minors in any way, is pornographic, is non-bar products and / or service, is non-restaurant product and / or related. RestoEquip.com reserves the right, at its sole discretion to suspend or remove any Classified Ad or Content, or to suspend any User Account, which it deems inappropriate or to have violated these TOU. 9. NO SPAM POLICY You understand and agree that sending unsolicited email advertisements to RestoEquip.com email addresses, through the Website or through the Services is expressly prohibited by these TOU. You understand that from time to time, you may receive communications from prospective buyers. While RestoEquip.com never shares your email address, we do forward emails to you when a prospective buyer chooses the ‘Email Seller’ option available from various areas of RestoEquip.com. 10. LIMITATIONS ON SERVICE You acknowledge that RestoEquip.com may establish limits concerning use of the Service, including the maximum number of days that Content or Classified Ads will be retained by the Service, the maximum number and size of postings and associated pictures, email messages, or other Content that may be transmitted or stored by the Service, and the frequency with which you may access the Service. You agree that RestoEquip.com has no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Service. You acknowledge that RestoEquip.com reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that RestoEquip.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. 11. ACCESS TO THE SERVICE RestoEquip.com grants you a limited, revocable, nonexclusive license to access the Service and the Website for your own personal use. This license does not include any collection, aggregation, copying, duplication, display or derivative use of the Website, any Content or the Service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by RestoEquip.com. RestoEquip.com permits you to display on your website, or create a hyperlink on your website to, individual postings on the Service so long as such use is for noncommercial and/or news reporting purposes only (e.g., for use in personal web blogs or personal online media). If the total number of such postings displayed or linked to your website exceeds two hundred (200) postings, your use will be presumed to be in violation of the TOU, absent express permission granted by RestoEquip.com to do so. You may also create a hyperlink to the home page of the Website so long as the link does not portray RestoEquip.com, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive matter. Use of the Website or the Service beyond the scope of authorized access granted to you by RestoEquip.com immediately terminates said permission or license. In order to collect, aggregate, copy, duplicate, display or make derivative use of the Service or any Content made available via the Website for other purposes (including commercial purposes) not stated herein, you must first obtain a license from RestoEquip.com, by contacting the Website administrator. 12.
